2. About Salem Barker

Salem Barker is an independent wood sculptor operating a direct-to-consumer art sales business from South Beloit, Illinois. All artwork sold through this Site is original, hand-crafted, and one-of-a-kind unless explicitly stated otherwise.

3. Products and Availability

• All artworks listed on the Site are subject to availability. Because each piece is one-of-a-kind, once a product is sold, it is removed from the shop.
• Product descriptions, dimensions, and photographs are provided in good faith and are as accurate as reasonably possible. Colors may vary slightly depending on monitor calibration.
• We reserve the right to discontinue any product listing at any time without notice.

4. Pricing

All prices are listed in US dollars (USD) and are subject to change without notice. The price displayed at the time of checkout is the price you will be charged. We are not obligated to honor pricing errors or outdated prices.

5. Orders and Payment

• Orders are accepted through the secure checkout on this Site. We accept major credit cards and other payment methods as listed at checkout.
• Payment is processed through third-party payment providers (such as Stripe or PayPal). By placing an order, you authorize us to charge your selected payment method for the full order amount.
• We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or that contain pricing errors.
• You will receive an order confirmation email after your purchase is complete. This email constitutes our acknowledgment of your order, not our final acceptance of it.

6. Shipping and Delivery

• We ship to addresses within the United States. International shipping inquiries should be directed to us by email prior to purchase.
• All artworks are packaged with care and shipped fully insured. Estimated delivery times will be provided at checkout and in your order confirmation.
• Shipping costs, where applicable, are calculated at checkout based on destination and artwork size.
• Risk of loss and title for items purchased pass to you upon delivery to the carrier. If your artwork arrives damaged, you must document the damage and notify us at salem@salembarker.com within 48 hours of delivery.

7. Returns and Refunds

• All sales of original artwork are final. We do not accept returns for buyer’s remorse or change of mind.
• If your artwork arrives damaged due to shipping, we will work with you to file an insurance claim and arrange a replacement or refund at our discretion. You must notify us within 48 hours of delivery with photographic evidence of the damage.
• Commission disputes or concerns must be raised within 14 days of delivery. We are committed to customer satisfaction and will evaluate each situation fairly.

8. Commissions

Commission inquiries are welcome and may be submitted through the Contact page. Commission agreements, pricing, timelines, and deposit requirements will be confirmed in writing via email before any work begins. Commissions are subject to separate written terms agreed upon at the time of engagement.

9. Intellectual Property

All artwork, photography, text, and other content on this Site is the intellectual property of Salem Barker unless otherwise stated. You may not reproduce, distribute, display, or create derivative works from any content on this Site without prior written permission.

Purchasing an artwork grants you ownership of the physical piece only. It does not transfer copyright or reproduction rights. We retain the right to photograph and display all sold works in our portfolio, on social media, and in press materials.

10. User Conduct

By using this Site, you agree not to:

• Use the Site for any unlawful purpose or in any way that violates these Terms.
• Attempt to gain unauthorized access to any part of the Site or its systems.
• Interfere with or disrupt the functionality of the Site.
• Submit false, misleading, or fraudulent orders or inquiries.

11. Disclaimer of Warranties

This Site and its contents are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Winnebago County, Illinois.
